What do you charge?

Do I need to bring anything with me for my consultation?

You don’t NEED to bring anything with you for your consultation.  However, the more information and paperwork you have regarding your current family law related issue, the more information Attorney Sommer or Attorney O’Donnell may be able to provide you at the consultation.

What is a refundable retainer?

A refundable retainer is a sum of money you deposit at the start of your case.  We bill against that retainer for your matter based upon the time we spend on your case.  At the end of your case, anything remaining in your trust account is returned to you.  Contact Attorney Sommer or Attorney O’Donnell to set up your consultation.

Is PA a fault state for divorce?

In Pennsylvania, you have the option of filing for a no fault divorce or a divorce based on fault grounds.  It is best to consult with Attorney Sommer or Attorney O’Donnell to discuss the various options for your possible divorce.

If I move out, does that mean I am “abandoning” everything I own and will not get anything from the divorce?

No.  This is a common misconception.  You are not abandoning your marital property.  Pursuant to Pennsylvania law, marital property is everything that you and your spouse accumulate during marriage, with a few exceptions.  Attorney Sommer and Attorney O’Donnell will be happy to discuss exactly what marital property entails during your consultation.

How does a Judge decide which parent receives custody of the child/children?

Pennsylvania law requires that a Judge must carefully consider sixteen factors that center around the “best interest” of the child/children when fashioning the custody decision.

Can I terminate the other biological parent’s rights?

Possibly.  However, terminating parental rights is very case specific. You can set up a consultation with Attorney Sommer and Attorney O’Donnell regarding terminating the parental rights of a biological parent and/or possible adoption of your child/children.

Can a grandparent adopt my child?

Possibly.  A grandparent adoption is very case specific.  You can set up a consultation with Attorney Sommer and Attorney O’Donnell regarding a grandparent adoption.

What are Grandparent’s Rights? What does that mean?

Well…Pennsylvania law outlines different types of standing that grandparents may have to file for custody of a minor child.  Each case is different, and it’s best to consult with Attorney Sommer or Attorney O’Donnell to discuss Grandparents rights and the facts surrounding your case.

Isn’t it true, PA tends to favor Mothers in custody actions?

This is a common misconception.  No preference exists for either parent!  In fact, Pennsylvania has enacted a statute which requires a Judge to consider sixteen custody factors that center around the “best interest” of the child/children. 

What counties do you practice in?

Cumberland, Dauphin, York, Franklin, Fulton, Bedford, Perry, Juniata, Huntingdon, Adams, Lancaster, Lebanon and all Pennsylvania counties.

Can I quit my job to stop paying Child Support and/or Spousal Support?

You certainly can quit your job; however, you will still be responsible to pay child support and Domestic Relations will most likely hold you to what you were earning at the job you quit.  It’s best to discuss your support matter with Attorney Sommer or Attorney O’Donnell to determine what best fits your situation.
